If your organisation is covered by the Fair Work Act, the employment contract tool can be used at https://employ.business.gov.au/
Generally, an employment contract should include –
- Definition of which award governs the employment relationship (List of awards – Fair Work Ombudsman)
- Position title, including what the equivalent classification is in the award
- You will need to determine the classification or level of the employee in the award, which needs to be linked to the position description created
- Employment type (full time, part time, casual, fixed term)
- Commencement date
- Hours of work
- Remuneration – hourly rate and allowances (the award pay guide on the FWO website can assist with this)
- Termination parameters
Accompanying the contract should be any Fair Work Information Statements and a position description –
- Fair Work Information Statement – Fair Work Ombudsman
- Casual Employment Information Statement – Fair Work Ombudsman
- Fixed Term Contract Information Statement – Fair Work Ombudsman
Key company policies can be included in employment contracts, however having them as standalone policies within the organisation provides flexibility for the review and amendment of these policies.
